Terms of use

Who this is from

Celestrike is made and published by an independent developer. Questions about these terms: hello@celestrike.com. By installing or playing the game you agree to what is on this page. If you do not agree to it, do not install the game, and delete it if you already have.

Your licence

You are granted a personal, non-exclusive, non-transferable, revocable licence to install and play Celestrike on devices you own or control, for non-commercial personal use. That licence is all you get: the game, its code, its art, its writing, its name and its logo remain ours.

You may not sell, rent, sublicense or redistribute the game or any part of it; remove or alter any notice in it; or attempt to decompile or reverse engineer it, except to the extent the law where you live says you may do so regardless of this paragraph.

Fiction

Celestrike is a work of fiction. Its orbital mechanics are modelled honestly, but its spacecraft, hardware, ground sites, agencies and scenarios are invented, and nothing in the game is a claim about any real country, organisation, company or person. It is not instructional material and it is not operational information.

Your save data

The game stores your campaign on your own device and sends it nowhere. That is set out in full in the privacy policy, and it has one practical consequence worth repeating here: there is no cloud save and no backup on our side. Deleting the app, resetting the campaign from the profile screen, or losing the device loses the campaign, and we cannot restore it.

Modifying the save file is not something we can police and not something we will support. If an edited save produces a broken campaign, the fix available to you is to reset it.

Cost, and purchases

This version of the game is free and contains no in-app purchase. Nothing in it is gated, and there is no payment code in the app at all.

If a future version adds a purchase, it will be described where it is offered, this page and the privacy policy will be updated before that version ships, and anything you already have will stay yours. Purchases, if they ever exist, are processed and refunded by the app store you bought from under that store's own terms, not by us.

Availability and changes

The game runs entirely on your device and needs no service from us to work, which means it keeps working whether or not we are still updating it. We may change, add or remove features in later versions, and we may stop publishing updates. We are not obliged to keep any particular feature, and we do not guarantee that the app will remain compatible with future versions of your device's operating system.

We may update these terms. If we do, the date at the top of this page changes, and material changes will be noted in the release that introduces them. Continuing to play after a change means you accept the updated terms.

Age

Celestrike is not directed at children under 13, and you should be at least 13 — or the minimum age for entering an agreement like this one where you live, whichever is higher — to play it. If you are under the age of majority where you live, a parent or guardian should read this page with you.

Acceptable use

Do not use the game for anything unlawful, and do not use it in a way that interferes with anyone else's device or with the app store's own systems. The game has no accounts, no chat and no multiplayer, so there is nothing here about other players — if that changes, so will this section.

No warranty

The game is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the game will be uninterrupted, error-free, or free of defects, or that it will meet your requirements.

Nothing in these terms limits any right you have under consumer protection law that cannot be limited by agreement. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or exemplary damages, or for loss of data — including a lost campaign — arising out of or in connection with the game. Where liability cannot be excluded, it is limited to the amount you paid for the game, which for this version is nothing.

Again, this does not affect rights you have under law that cannot be excluded.

The app stores

These terms are between you and us, not between you and Apple or Google. Neither store is responsible for the game or for supporting it, and support requests should come to support@celestrike.com. Where the game is obtained from the Apple App Store, Apple is a third-party beneficiary of these terms and may enforce them against you, and your use is also subject to Apple's own Licensed Application End User Licence Agreement, which applies in place of anything on this page that conflicts with it. Where the game is obtained from Google Play, your use is also subject to Google's terms of service.

If the game fails to conform to any warranty Apple is required to provide, you may notify Apple, and Apple will refund the purchase price — which for this version is zero. Any other claim about the game is ours to answer, not Apple's.

Ending the licence

You can end this agreement at any time by deleting the app. We may end it if you breach these terms in a way that matters. Either way, the sections on ownership, warranties and liability survive.

The rest

If any part of these terms is held unenforceable, the rest still stands, and the unenforceable part is applied as closely to its intent as the law permits. Failing to enforce something is not a waiver of it. These terms, with the privacy policy, are the whole agreement between us about the game.
